As the demand for affordable housing rises in the United States, states such as Texas and California have started relaxing their regulations surrounding properties installing Accessory Dwelling Units, or ADUs. Recently, Arizona will join this trend with the newest House Bill 2720.

An accessory dwelling unit (ADU) is an extra living space on your property, typically in the backyard. ADUs are commonly called granny flats, cottages, casitas, or in-law suites.   • Permitted Uses: Municipalities must allow at least one attached, detached, or internal ADU. This must be for each single-family home and an additional ADU for each ADU classified as a restricted-affordable dwelling unit.
  • Size Regulations: The bill stipulates that an ADU may occupy up to 75% of the gross floor area. This must be a primary single-family dwelling or a maximum of 1,000 square feet, whichever is smaller. This flexibility ensures that homeowners can maximize their property’s utility.
  • Restrictions Lifted: The legislation prohibits municipalities from imposing excessive regulations that could hinder the development of ADUs. For example, municipalities cannot require familial relationships between occupants of the primary dwelling and the ADU, mandate specific kitchen facilities, or impose stricter zoning requirements on ADUs than on single-family homes.

Encouraging Affordability and Flexibility

One of the most compelling aspects of House Bill 2720 is its potential to enhance housing affordability in urban areas. By allowing ADUs, homeowners can create additional rental spaces, providing much-needed housing options for low- to moderate-income residents.

The bill’s provisions also allow homeowners to use their properties flexibly. For instance, an empty nester could convert part of their home into an ADU for a visiting family member while renting it out for supplemental income.
